When your case is derailed due to your attorney’s negligence

On Behalf of Schwartz & Ponterio, PLLC | Mar 21, 2024 | Legal Malpractice

Your lawyer is supposed to champion your legal rights, guiding you through the justice system. What happens when they make a critical mistake, jeopardizing your case? Legal malpractice can leave you feeling frustrated, helpless and financially worse off.

Legal malpractice is not simply about losing a case. Lawyers are held to a professional standard of care, meaning they must possess the skills and knowledge a competent attorney in their field would have and must exercise those virtues accordingly. Breaching this standard and causing you harm can be grounds for a legal malpractice claim.

When mistakes turn into misconduct

One way a legal professional’s negligence can manifest is through missed deadlines or missed court appearances. Imagine a scenario where your lawyer fails to prepare a crucial document by the deadline, jeopardizing your entire case. Or perhaps they missed a critical court conference where key evidence could have been presented. These errors can have devastating consequences, significantly weakening your case or even leading to its dismissal.

Missed deadlines and court appearances are just a few examples of attorney negligence. Here are some other actions that could constitute legal malpractice:

  • Failing to properly investigate your case: A lawyer who doesn’t thoroughly investigate your case might miss crucial evidence or legal arguments.
  • Misrepresenting the law or facts: If your lawyer gives you incorrect legal advice or misrepresents facts in court, it can severely damage your case.
  • Conflicts of interest: An attorney should not represent you if they have a conflict of interest, such as also representing the opposing party.

Don’t stay silent if you believe your lawyer’s negligence has harmed your case. It would help if you documented everything related to your case, including communication with your lawyer and any missed deadlines or errors.

Legal malpractice can be a complex legal matter, but you don’t have to face it alone. By understanding your rights and reaching out to a competent legal team, you can work to hold your lawyer accountable for their negligence and potentially recover damages for your losses.
