When trouble with alcohol leads to legal malpractice

Regardless of the fact that attorneys are held to high ethical and professional standards, they may struggle with personal challenges, including substance abuse. When a lawyer’s issues with alcohol affect their ability to represent clients properly, it can lead to legal malpractice.

Clients depend on their attorneys for sound guidance, timely action and competent representation. If a lawyer’s impairment causes errors that harm a client’s case, that client may have grounds for a legal malpractice claim.

What can happen, and what clients can do about it

Alcohol-related impairment can result in serious professional misconduct, including missed deadlines, failure to appear in court, poor legal strategy and lack of communication with clients. A lawyer struggling with alcohol dependency may neglect important filings, mishandle evidence or fail to meet court-ordered deadlines, all of which can result in severe consequences for a client’s case.

For example, a lawyer struggling with addiction may fail to act within the statute of limitations. If an attorney misses a deadline to file a lawsuit or respond to court motions, the client may lose their ability to pursue a claim altogether. When an attorney’s alcohol-related negligence leads to this kind of irreversible damage, the client may be able to pursue legal recourse via a malpractice claim in civil court.

Clients may not always immediately realize that their attorney’s issues with alcohol have affected their case. Warning signs include frequent cancellations or rescheduled meetings, difficulty reaching the attorney, lack of preparation in court or unexplained delays in progress. If a client suspects that their case has been negatively impacted due to their lawyer’s misconduct, seeking a second legal opinion is a good first step forward.

Legal malpractice claims require proving that the attorney failed to meet their professional duties and that this failure caused harm to a client. Seeking personalized guidance and support can help those affected by alcohol-related malpractice to pursue justice accordingly.
