What are the ethical duties of a lawyer to a client?

On Behalf of Schwartz & Ponterio, PLLC | Oct 25, 2024 | Legal Malpractice

Like all professions, the legal profession is governed by ethics and professional responsibility, which dictate the standards of conduct that lawyers must follow in their practice. A lawyer’s failure to adhere to these ethical duties can lead to legal malpractice claims and damage to their professional reputation.

When you enlist the services of an attorney, you place your trust in their legal knowledge and expect them to uphold certain ethical standards throughout your representation. This is fundamental to the attorney-client relationship and includes several key duties.

Communication

Attorneys are required to maintain open and transparent communication with their clients. This includes providing regular and timely updates on the status of their case, explaining legal concepts in simple terms and making sure clients understand their options. Effective communication helps clients to make informed decisions.

Confidentiality

Confidentiality of information is another important ethical duty that attorneys must uphold. Lawyers are obligated to protect all communications and information shared by clients, making sure that sensitive details remain private unless the client provides informed consent to disclose them. This duty creates a secure environment for clients to discuss their legal matters openly, knowing that their privacy will be respected and maintained.

Competence

You have a right to receive competent representation from your attorney. This means that lawyers must possess the necessary legal knowledge, skills and experience to effectively handle your case. They should stay updated on relevant laws and procedures to better ensure they can advocate for your interests effectively.

Reasonable billing

Lawyers should be clear about their fee structures and provide clients with a reasonable billing process. This includes offering detailed explanations of how fees are calculated, informing clients about any additional costs that may arise and making sure that charges are fair and commensurate with the services provided. Transparency in billing practices helps clients understand their financial obligations and builds trust in the attorney-client relationship.

If you feel that your lawyer is not meeting these ethical duties or if you have concerns about their conduct, it is important to seek legal guidance to understand your options.
