When you may be able to file a legal malpractice claim

Most people, at some point in life, require assistance from an attorney — whether for personal or business-related reasons. They do their due diligence and seek out legal counsel whom they believe will be a good fit for their needs. While many New York residents have had successful encounters with their attorneys, others have not been so fortunate. Sometimes things do not work out as one expects, and in some cases, legal malpractice is to blame.

Common problems that indicate legal malpractice include dishonesty, inaccurate billing, failure to communicate and poor performance. If an individual believes his or her attorney is guilty of any of these things, there are a few ways to address the situation. One can:

  • Talk it out
  • Report the issue to the bar association
  • Retain new legal counsel
  • Consider alternative dispute resolution methods
  • Litigate the matter

Litigation is usually a last resort option. It is generally better for everyone involved to attempt to settle out of court; however, there are times when that is just not possible. For this reason, having legal representation who knows the way around a courtroom is wise. It is better to prepare for the worst and hope for the best.

Legal malpractice is not something to brush under the rug. It can cost its victims significantly, both economically and otherwise.
